Air conditioning noise and neighbourhood disputes: what does the law say in 2026?

Every summer, the same scene plays out in the apartment buildings of the Paris region: a neighbour installs an air conditioner, another can no longer sleep. Air conditioning noise has become, with successive heatwaves, one of the leading sources of neighbour disputes in France. Complaints at the town hall, neighbourhood conciliations, court summons: what exactly does the law say in 2026, and how do you make sure your AC does not end up in front of a judge?

Why air conditioning noise creates so much tension

France now has more than 6 million individual air conditioners in service (GIFAM 2026 estimate), compared to 2.5 million in 2018. At the same time, urban density has increased, heatwave episodes have multiplied, and the air conditioning usage period is lengthening every year: in the Paris region, the AC runs on average 110 days a year, compared to 60 days ten years ago.

The acoustic problem is specific to AC: it is not a one-off noise, it is a permanent background hum that can last for weeks. Three sound sources add up:

  • The compressor of the outdoor unit (often between 45 and 60 dB(A) at 1 m for a residential split).
  • The fan of the indoor unit (20 to 35 dB(A) in normal mode, more in turbo mode).
  • Vibrations transmitted to the facade or to the mount, which propagate through the building structure.

At the scale of a building, these noises stand out above the ambient noise and create an abnormal neighbourhood disturbance, especially at night when silence is expected.

What the law says in 2026: the texts you need to know

French regulations on AC noise are based on a stack of texts that you must master before any dispute, whether you are the victim or the accused.

1. The Public Health Code: night disturbance and neighbourhood noise

Two articles are at the centre of the system:

  • Article R. 1334-30: constitutes a night disturbance any noise likely to harm the peace of the neighbourhood or human health, committed between 10pm and 7am. Penalty: 3rd class fine (up to €450).
  • Article R. 1334-31: no particular noise must, by its duration, repetition or intensity, harm the peace of the neighbourhood, day or night.

Case law has long considered that an AC that runs all night above the ambient noise can constitute a night disturbance, even if the legal emergence threshold is not strictly exceeded: it is the judge who assesses the intensity on a case-by-case basis.

2. The emergence rule: +5 dB(A) by day, +3 dB(A) at night

The emergence is the difference between the ambient noise with the AC and the residual noise (without the AC). The thresholds to be respected are:

  • +5 dB(A) by day (7am-10pm) and +4 dB(A) in the intermediate period (6am-7am and 10pm-11pm).
  • +3 dB(A) at night (10pm-7am).

Beyond these thresholds, you are in breach. In practice, an outdoor AC at 50 dB(A) at 1 m placed 3 m from a neighbour's window can already exceed these values at night, when the background noise drops to 30-35 dB(A).

3. The order of 23 January 1997 and the NF S 31-010 standard

For residential buildings, the order of 23 January 1997 sets acoustic thresholds to be respected for collective technical equipment. The NF S 31-010 standard specifies the measurement methods and admissible thresholds for individual installations. For an AC, the emergence must also be measured in the main rooms of the neighbouring dwelling, with the windows closed.

In condominiums, the condominium rules can be stricter than the law: they can purely and simply prohibit the installation of air conditioners on the facade, or require a reserved location on the roof or in the interior courtyard. The rules take precedence over the law in case of an internal dispute.

Who is responsible in case of complaint?

The chain of responsibility depends on the type of installation and the housing status.

You are an owner-occupier

You are 100% responsible for your installation. The fine, the damages, and, in case of serious abnormal disturbance, the injunction to carry out soundproofing work (under penalty) are at your expense.

You are a tenant

You are responsible for the disturbance you generate on a daily basis: use in the middle of the night, excessive setting, failing maintenance. The landlord may be held liable if the installation itself is defective from the start (excessive vibrations, poorly fixed mount). In practice, in case of complaint, you will often be asked to justify the regular maintenance of the device (invoices, contract).

You are in a condominium

Article 9 of the condominium rules obliges each co-owner to use their private space with respect for others. The property manager, approached by a neighbour, can put on the agenda of the next AGM the question of the disputed installation. The co-owner concerned is exposed to damages paid to the syndicate (Article 14-1) or to the injured neighbour.

Concrete solutions for silent air conditioning

Before reaching the point of conflict, it is better to prevent. A well-designed, well-installed and well-maintained AC is 20 to 30% quieter than a standard poorly installed one.

Equipment side

  • Choose a recent inverter split: the power variation avoids the noisy on/off cycles of the compressor.
  • Check the sound power in dB(A) on the manufacturer's data sheet, not just the cooling capacity. Good models drop below 21 dB(A) in silent mode for the indoor unit.
  • Opt for a device carrying the NF label or the Eurovent certification, guarantees of measured acoustic performance.

Installation side

  • Place the outdoor unit on silent blocks or an anti-vibration mount.
  • Move the outdoor unit away at least 3 metres from neighbours' windows, favouring installation on the courtyard or garden side.
  • Insulate the mount from the wall with a cork or rubber plate to prevent the transmission of vibrations.
  • Install, if necessary, a specific soundproofing enclosure (check that it does not hinder the ventilation of the device).

Use side

  • Activate the night mode (or "silent") in the evening, which reduces the speed of the compressor and the fan.
  • Schedule an automatic stop between 11pm and 6am in residential use, especially if the noise bothers.
  • Clean the filters every 2 to 4 weeks during intensive use: a clogged filter forces the fan to spin faster and makes more noise.

Maintenance side

A dirty device is almost always noisier: an obstructed outdoor heat exchanger makes the compressor work in overdrive, vibrations increase. An annual check by a certified refrigeration technician (verification of fixings, balancing, refrigerant charge) guarantees stable and silent operation, and provides a useful certificate in case of dispute. What to do in case of a neighbour's complaint?

If a neighbour complains about the noise of your AC, it is better to react quickly, before the formal notice.

  1. Get in touch with the neighbour and listen to the complaint: often, a simple adjustment (night mode, stop time, moving the indoor split) resolves the conflict amicably.
  2. Have the ambient noise measured by an acoustician or an acoustic engineering firm. The report costs between €600 and €1,500 and stands up in court.
  3. Consult the condominium rules to check the compliance of the installation.
  4. As a last resort, refer the matter to the justice conciliator (free of charge) before any appearance before the judicial court.

If you are the victim, the path is symmetrical: written record, registered letter with acknowledgement of receipt, attempt at conciliation, then referral to the court in case of failure. Tenants' associations and the ARS (Regional Health Agency) can also intervene for the most serious cases.

Links with other regulatory obligations

The installation of an outdoor AC is also framed by other texts, which must be considered as a whole:

  • The F-Gas regulation 2026 requires a leak check for devices containing more than 5 tonnes of CO₂ equivalent of refrigerant. A non-compliant installation is an additional offence, regardless of the noise.
  • The R32 refrigerant is now required for new residential splits: an F-Gas compliant device runs at an optimised charge and is quieter than a poorly charged old R410A.
  • For condominiums, maintenance with the property manager often deserves an acoustic charter annexed to the rules, to prevent each individual installation from degrading the comfort of the building.
